Internal and external whistleblowing
The Municipality of Lisbon has an Internal Whistleblowing Channel and an External Whistleblowing Channel, which can be accessed independently and autonomously via the contracted “+Transparent” platform.
External reporting channel
The External Whistleblowing Channel is intended for the submission of complaints by any other whistleblower, as well as, in accordance with the provisions of Article 7(2) of Law 93/2021 of December 20, when:
the whistleblower/employee has reasonable grounds to believe that the infringement cannot be effectively known or resolved internally or that there is a risk of retaliation;
or
has initially lodged an internal complaint without being informed of the measures envisaged or adopted following the complaint within the time limits provided for in Article 11 of Law 93/2021 of December 20;
or
the infringement constitutes a crime or an administrative offense punishable by a fine of more than €50,000.
Internal complaints channel
The internal whistleblowing channel must be used solely and exclusively by employees of the Municipality of Lisbon.
Reporting a complaint
What?
Identification of the type of infraction, irregularity and/or malpractice on which the complaint is based.
As detailed a description as possible of the situation being reported.
Who?
Full names, if possible, of the people involved and their roles.
Full name, if possible, of witnesses, if any.
When?
Date or dates on which the situation complained of happened, is happening or will happen.
Where?
Unit, block, floor, department, service.
How much?
If applicable, and when possible to calculate, indicate the amounts involved in the situation being reported.
Presentation of evidence
If it exists and where it can be found. You can also attach documents or other files.
The Internal and External Complaints Channel should not be used to submit complaints about services or mere disagreements with the internal procedures adopted by the Municipality of Lisbon.
For this purpose, the proper communication channels provided by the Municipality of Lisbon should be used, such as:

- Online booking to make an appointment;

Consult the list of all communication channels
The processing of personal data contained in a complaint complies strictly with the provisions of the following legislation:
- In the General Data Protection Regulation (GDPR), approved by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016;
- Law no. 58/2019, of August 8, which ensures the implementation, in the national legal order, of Regulation (EU) 2016/679;
- Law no. 59/2019, of August 8, which approves the rules on the processing of personal data for the purposes of the prevention, detection, investigation or prosecution of criminal offenses or the execution of criminal penalties.
In accordance with the principle of data minimization (article 5 of the GDPR), personal data communicated in a complaint that is clearly not relevant to the processing of the complaint is not kept and is immediately deleted (article 20, no. 2 of the Internal Operating Regulations of the Lisbon City Council Complaints Channel).
The data of the people involved in the process is managed in accordance with the provisions of the Municipality of Lisbon's Privacy and Personal Data Protection Policy.
About the municipality's complaints channel
Decree-Law no. 109-E/2021 of December 9 created the National Anti-Corruption Mechanism and established the General Regime for the Prevention of Corruption (RGPC), which is applicable to services and legal entities in the direct and indirect administration of the state, the autonomous regions, local authorities and the public business sector that employ 50 or more workers.
The list of regulatory compliance and corruption prevention instruments includes the existence of Whistleblowing Channels and the follow-up of reports of acts of corruption and related offenses, under the terms of Law 93/2021 of December 20, which establishes the general regime for the protection of whistleblowers, transposing Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019 on the protection of persons reporting breaches of Union law.
The Reporting Channel of the Municipality of Lisbon (ML) allows all those who work there and any natural person who has a direct or indirect relationship with ML to report situations of non-compliance with the principles and values of an ethical nature and/or situations of illegality, such as corruption and related infractions, found within the scope of municipal activity.
The Whistleblowing Channel is operated externally, under the terms of Law no. 93/2021, of December 20, for the purpose of receiving complaints, in accordance with the rules of the operator that ensures the operation of said Channel.
In order to guarantee the security, confidentiality and integrity of the information communicated, the process of receiving complaints was contracted to a specialized and independent company, CLOSER - Consultadoria, Lda. (now EVALYZE AIOPS, Lda., by assignment of the contractual position) whose platform is called + Transparente.
The Internal Operating Regulations of the Lisbon City Council Complaints Channel establish the internal rules and procedures associated with the monitoring, management, treatment and resolution of complaints received by the Lisbon City Council Complaints Channel, defines the communication circuit and also the parties involved in this system, in line with the provisions of the Lisbon City Council Code of Ethics and Conduct and the Lisbon City Council Transparency and Anti-Corruption Strategy.
Internal Operating Regulations

Following the amendment to the organizational structure of the Municipal Services, Nuclear Structure and Flexible Structure, of the Municipality of Lisbon, published through Notice no. 7084/2023 in the Diário da República, 2nd series, no. 68, of April 5, the Department of Quality Management and Auditing was abolished and the Department of Transparency and Corruption Prevention was created as part of the Prevention and Control Division, with powers to implement regulatory compliance instruments, namely the Whistleblowing Channel.
Quarterly report from the Whistleblowing Channel platform
In accordance with articles 34 and 35, both of the internal operating regulations of the Municipality's whistleblowing channel, a summary report is drawn up each year describing the complaints received, the procedures adopted, the results obtained and the respective conclusions, with all personal details of the complainants, accused or third parties identified removed, to be published in the Transparency area of the Lisbon City Council website.
